Hangar Owners, Aircraft Owners, and Gas Pool Members:
Below you will find an updated Brodhead Airport Rules and Hangar and Aircraft Owners with Hawk-Aire, Inc. along with your hangar bill. There are several things we would like to call to your attention.
NO WORK FEE - All hangar owners. aircraft owners. and gas pool members will need to participate at one of the 2 workdays held at the airport. If unable to attend the workdays, there is always on going maintenance to be done.
Failure to help with the maintenance of the airport will result in a $100.00 no work fee.
PROOF OF INSURANCE -(page 6 -IV AIRCRAFT OPERATIONS -A -2) Hawk-Aire, Inc. is requiring all aircraft owners, with aircraft based at Brodhead Airport, to send verification of liability insurance to Hawk-Aire, Inc. Call your insurance company and ask them to send insurance verification to:

MEMBER OF CHEESELAND CHAPTER 431 AND NATIONAL EAA - Hawk-Aire, Inc. will continue to require all hangar owners, aircraft owners, and gas pool members to be members of Cheeseland Chapter 431 and the National EM.

BRODHEAD AIRPORT RULES
AND
HANGAR AND AIRCRAFT OWNERS AGREEMENT
WITH HAWK-AIRE INC.
I. BRODHEAD AIRPORT OPERATION
A. Hawk-Aire Inc. is the owner, operator, and holds legal title to the Brodhead Airport
B. Hawk-Aire Inc. is responsible for maintaining runway surfaces, runway lighting, and aircraft fueling facilities.
C. All Owners of hangars and aircraft based on the Brodhead Airport must abide by this agreement. This agreement may be amended from time to time by the board of directors of Hawk-Aire Inc.
II. HANGAR OWNERS
A. Approval for building, improving, remodeling, removal, demolition, selling, renting, or renting space in a hangar
1. No hangar may be built, improved, remodeled, removed, demolished, sold, rented or space rented without the approval of the Board of Directors of Hawk-Aire Inc.
a. Request must be in writing to the Board of Directors of Hawk-Aire Inc. and must include the name and address of all prospective builders, buyers, or renters. This request must include National EAA # and the expiration date of all parties.
b. The Board of Directors of Hawk-Aire Inc. are the sole authority for approving or denying requests.
c. Hawk-Aire Inc. reserves the right of first refusal to purchase any hangar that is being sold. The hangar owner must present in writing to Hawk-Aire Inc. Board ofDirectors a bonafide offer to purchase. Hawk-Aire Inc. will have up to 45 days from the date of notice to purchase the hangar at the price of the bonafide offer.
2. Hangar Sites
a. Approval to build a hangar above will include authorization for a specific location (site) on which to build the hangar.
b. Hawk-Aire Inc. has and retains all rights, title and interest in the real property comprising the Brodhead Airport, including any and all hangar locations.
c. Approvals are valid for one year from date of issuance by the Board of Directors. If a hangar is not substantially erected withjn that year or an extension obtained per ( d) below, hangar approval is deemed withdrawn.
d. Extending Approval
i. If a builder does not substantially erect a hangar and there are no bonafide requests by someone else for the site within the 12 month period, the builder then will have the option to pay Hawk-Aire Inc. a site fee which will extend the building approval and site authorization for 12 additional months.
ii. Builder may continue this on a yearly basis so long as there are no bonafide requests for the site. If there is a bonafide request, the hangar then must be built in the 12 month period. If builder fails to do so, he then loses the hangar and site approvals at the end of the period.
iii. "Bonafide request" is defined as a request from another approve. I hangar builder who has requested that particular site also.
iv. Site fees will be set from time to time by Hawk-Aire Inc. Board of Directors.
B. Financial Obligations of Hangar Owners
I. Hangar Owners are required to own three shares ofHawk-Aire Inc. stock for each hangar they own. The stock may be purchased over a consecutive three year period by purchasing no less than one share per year. A
minimum of one share must be purchased prior to ownership or construction of the hangar. A check made out to HawkAire, presented to the Hawk-Aire Inc. Board ofDirectors, for one or more shares will be required before approval of sale or construction.
2. Hangar Owner Fees
a. Hangar Owners will be charged a use fee on an annual basis. The fee is determined annually by the Board ofDirectors ofHawk-Aire Inc. Hangars erected after January I st, will be prorated to the nearest month.
b. Hangar Owners must be members in good standing of BAA Chapter 431 and the International BAA.
c. Hangar Owners are responsible for the airport user fee due on all aircraft stored in their hangar. This includes aircraft not owned by the Hangar Owners ( see Article ill).
d. An initial electrical hookup fee is charged to all Owners of newly built hangars. It is a one time fee and is set by the Board ofDirectors of Hawk-Aire Inc.
e. All hangar Owners will be charged an annual electrical use fee for
each hangar they own. This fee is detennined on an annual basis by
the Board ofDirectors ofHawk-Aire Inc. In addition to the above fee, Hangar Owners may be required to pay for the electricity actually used in a hangar. The Board ofDirectors ofHawk-Aire Inc. makes this determination. Hangar Owners who are required to pay this charge will install an acceptable electrical meter on the outside of their
hangar. The meters will be read on January I and July I and will be billed at the WPL current rate at the time of the reading.
f. Hangar Owners shall be responsible to obtain, at their expense, bodilv injury and property damage liability insurance sufficient to cover any risk of loss arising from hangar ownership of construction.
g. Hangar Owners shall be responsible for and pay all personal property taxes and like fees and charges with respect to the hangar and other property kept by the Hangar Owner at the hangar site.
h. The current fee schedule is available upon request.
C. Hangar Construction Requirements
1. Hangar Owners are responsible for obtaining all applicable construction permits and approvals and for meeting all applicable building codes, including this agreement.
2. Hangar design needs to be approved by the Board ofDirectors of Hawk-Aire Inc. Hangars need to conform with the set back requirements. Hangars must be structurally sound and offer a presentable appearance.
3. The following building activities require specific approval by the Board of Directors ofHawk-Aire Inc. or their designated Airport Manager before the activity is started.
a. Excavating for any purpose.
b. Power and phone installation
c. Any exterior work on hangars including electrical and lighting. d. Whenever heavy ground vehicles will be driven to the hangar e. Approval for hangar modifications good for 12 months.
4. Hangar Owners are responsible for any damage to the airport, airport grounds, or Hawk-Aire Inc. or EM Chapter 431 property that is caused by the Hangar Owners, their contractors, and guests. This includes ruts created by heavy
vehicles. Any damage done to existing private utilities is the responsibility of the person having done it.
5. Hangar Owners must maintain the hangar and area around it in a presentable appearance.
6. Hangar Owners must install an acceptable electrical meter on the outside of the hangar at a convenient height for reading.
D. Hangar Use
1. The hangar shall not be used for commercial purposes unless specifically authorized in writing by the Board of Directors of Hawk-Aire Inc. Any commercial operation will be up for review by the Board ofDirectors ofHawk- Aire Inc. in December.
2. The primary use of the hangar shall be to store aircraft and aircraft related materials; however, this requirement does not necessarily restrict storage of additional items.
3. The hangar contents shall not present an unreasonable health, safety , or fire hazard. Each hangar must have at least one usable 10 pound ABC fire extinguisher.
4. Hangar Owners agree to allow an authorized representative ofHawk-Aire Inc. tc inspect hangar to verify compliance with all applicable articles set forth in this agreement.
E. Hangar Owners who do not significantly help with the operation and maintenance 0= the airport will be charged a non-work fee. The Board of Directors of Hawk-Aire Inc. determines on an annual basis the fee and who will be charged.
F. If Hangar Owners wish a variance from any of the requirements set forth herein, they must present such requests in writing to the Board of Directors ofHawk-Aire Inc., which will issue any variance granted in writing.
G. Hawk-Aire Inc. reserves the right to evict a Hangar Owner from the premises of the Brodhead Airport, and purchase, remove, or otherwise dispose of the Hangar Owner' c hangar. Eviction under this provision may only be authorized by a unanimous vote 01 the Board of Directors ofHawk-Aire Inc-
H. This agreement will insure to the benefit of all future Hangar Owners.
I. Hangar Owners indemnifies and holds harmless Hawk-Aire Inc., its officers, employees, agents and EAA Chapter 431, its officers, employees and agents from any and suites, claims, damages, judgment losses, and expenses, including reasonable attorney's fees, arising out of or resulting from the building, improving, remodeling, removal, demolition, selling, renting, or renting of space of a hangar on the premises of the Brodhead Airport.
ill. AIRCRAFT BASED ON AIRPORT
A. Procedures and conditions for basing aircraft at airport.
1. Aircraft Owners must request permission from Hawk-Aire Inc. to base an aircraft on the airport.
2. Airport Manager has authority to approve or deny request; however, the Airport Manager's decision can be reversed by a majority vote of the Board ofDirectors ofHawk-Aire Inc.
3. Aircraft Owners and/or Pilots and their aircraft can be evicted from the airport by a two-thirds vote of the Board of Directors ofHawk-Aire Inc.
4. A tie-down space will be provided if Aircraft Owner intends to keep aircraft outside. The Aircraft Owner is responsible for securing of the aircraft. Hawk- Aire Inc. does not and will not furnish tie-downs. It is entirely the Aircraft Owners responsibility .
5. Aircraft Owners who do not significantly help with the operation and
maintenance of the airport, will be charged a non-work fee. The Board of Directors ofHawk-Aire Inc. determines on an annual basis the fee and who will be charged.
6. Ground vehicles are to be parked in the parking lot. They should only be driven beyond the parking lot when absolutely necessary.
7. Aircraft Owners indemnifies and hold harmless Hawk-Aire Inc., its officers, employees, agents, and EAA Chapter 431, its officers, employees, and agents
from any and all suits, claims, damages, judgment losses and expenses, including reasonable attorneys' fees, arising out of or resulting from basing an aircraft at the Brodhead Airport.
B. Aircraft Owner Fees
I. Aircraft Owners must, in order to base an aircraft at the Brodhead Airport, be members in good standing of EAA Chapter 431 and the International BAA.
2. Fees for Aircraft based at Brodhead Airport
a. All aircraft parked outside will be charged a full fee
b. Commercial aircraft operations, such as flight instruction and agricultural spraying, will be charged fees as determined by the Board of Directors of
Hawk-Aire Inc. All commercial operations will be reviewed by Hawk- Aire Inc. Board of Directors each December .
c. Aircraft involved in non-commercial operation and based on airport less than a month, will not be charged a fee.
d. Fees are paid once a year for the full year. Aircraft that are moved on to the airport after J anuary I si and remain for more than a month will be charged a fee prorated to the first of the month in which they arrived. Refunds will be prorated to the end of the month in which the aircraft was removed; however, no refunds will be issued for aircraft removed after September 30th.
e. The current fee schedule is available upon request.
IV. AIRCRAFT OPERA TIONS
A. General requirements for all aircraft operated from Brodhead Airport.
1. Aircraft shall not be operated for commercial purposes unless authorized by the Board of Directors ofHawk-Aire Inc.
2. Aircraft must have liability insurance policy for a minimum of $250,000.00 in effect when the aircraft is operated. Proof of insurance must be provided to Hawk-Aire Inc.
B. Flight rules, ground rules, and cautions.
1. Aircraft parked and unattended must always be securely tied down.
2. Refrain from taxiing in the middle of the runway. Try to taxi on the sides where the grass is thicker.
3. Runways are not plowed in the winter.
4. Aircraft must be operated in accordance with current F AA regulations. 5. Left hand pattern only.
6. No straight in approaches
7. Runway 9/27 is the preferred runway when wind is calm. 8. Pattern altitude is 800 AGL.
9. Avoid operation when field is soft and muddy.
V. GENERAL AIRPORT RULES:
A. All members ofEAA Chapter 431 are welcome to use the Brodhead Airport.
However, beyond using common sense and being courteous and respectful of others there are some specific rules to follow.
1. When walking or driving on the airport, always be on the lookout for aircraft. Stay well out of the path of any aircraft.
2. Ground vehicles are to be parked in the parking lot. They should only be driyen beyond the parking lot when absolutely necessary.
3. Members may bring friends and relatives to the airport; however, the Member is responsible for their guests. Be especially watchful of children. NEVER allow children near any aircraft without owners consent. All children on airport must have direct adult supervision.
4. Members who wish to hold a special event at the airport should contact Hawk- Aire Inc. for permission. If it is a large event, it may require approval from the Board of Directors ofHawk-Aire Inc. Donations to Hawk-Aire Inc. for such special use events are appropriate.
5. Everyone is expected to remove their own trash and waste from the airport.
6. Whenever using the picnic/campground or chapter hangar, you are expected to clean up afterward and leave it neat and tidy.
7. Borrowing of chapter equipment for use off the airport premises is not allowed except for the following: Kitchen equipment, picnic tables and the charcoal grill~ may be borrowed by using the sign-out procedure posted in the chapter kitchen.
8. Hawk-Aire Inc. reserves the right to determine who is allowed to use the Brodhead Airport Property.
9. No snowmobiles allowed on the airport. 10. No hunting on the airport property.
11. All dogs must be tied or on a leash. Dogs are not to be running loose on the airport property .
12. The brush pile on the airport is for brush only! Use oil, furniture, carpeting, cans, glass, and plastic should not be dumped there. It is the Hangar Owners responsibility to dispose of these items.
